so if i have high enough stats for stealing i could steal from the guards, missles outside junkyard now? it seems some could do it without repercussions? ( i mean if i fail)

You will never be able to steal from gaurds/merchants. (you can't open their inventory)
Also, I have 300% steal on a cha. And even I tend to fail stealing 5 caps. Steal has been nerfed pretty hard really.
