I was talking about new games with new content. It is obvious that you can't use Fallout material (maps, graphics, etc) and release it as a new game + sell it.

The same fear that every Fallout mod has as well. I want to remember that in the licence agreements from Fallout 1 and 2 is stated that it's not allowed to modify or reverse anything of the game. Still, this rule has been broken over and over since many years now by various people. FOnline exists since at least 4 years now too.

Well in that part i was talking about the content of FOnline:2238 factoring out the content taken during runtime from master.dat and critter.dat of Fallout2. Your content is basically derivative work from Fallout2 Fallout1 etc.  You simply can't relicence that, you don't hold the copyright.

I wasn't aware of that, nice to know!  :). But these modding clauses usually have other part that limits where can be used the mods, and that normally means that the mod had to be used within the original game engine (For example all quakes again, and Fallout3 GECK). I don't have a boxed copy of Fallout2, where can i read his modding licence?

That's wrong. I asked (http://www.fonline.ru/forum/showthread.php?t=16600)  fonline never will be open source.

That's the question, to be able to relicense open product or it's derivative work you need to obtain full copyright or permission from full copyright owner.
I'm not shure that Cvet do have full right to Fonline sorce code and media.
As far as I know Fonline project was started by Olegmmm, Kosh and others in 2004, and Cvet joined this team in 2006. So it's not clear do Cvet owns full rights to Fonline or not.

In short, if you don't owns full copyrights to open project, you can't close it, or any derivative work from it.
And if you do so - it's illegal.

The original FOnline developers are long gone now, and Cvet has full access to everything in this project. They can't come and say "It's illegal", for the simple reason that, as stated above, FOnline itself is quite illegal.

Maybe FOnline will never be open-source, I don't know exactly the vocabulary for that. However, cvet said many times that Server Development Kit (SDK) will be released. They will virtually allow anyone to host its own game based on FOnline engine.(Afaik SDK will contain some version of TLA.)
