Steal not working in random encounters?

It's reasonable that such char CAN steal stuff, otherwise a part of this game is dead. It was hard to steal - it wasn't like in f1 / f2 where u can just go to every shopkeeper with 40% skill in stealing and take PA without any problem.  300% skill and pickpocket perk is max what u can get in this game an now even with such skill u can rly do shit.

stealing needed changes  but I don't know if it's a right call. but at least it's better than before.

yesterday some thief robbed me in NCR, I didin't mind because all I had was some crappy items and I just wanted him to fail once so I could shoot him. so I was standing right in front of him to make him fail, but still he menaged to steal like 10 different items and didin't fail once. I just watched my inventory dissapear.

how can someone steal over 10 items in a row when I was facing him and my character didin't notice it? I have 9 Perception for christ sake. it's not like I'm playing a retarded, drooling, blind, deaf wastelander without arms and legs.

They are doing it wrong.

Atom:
They (encounter guards) don't care what you're doing 1 hex next to them, they will always open fire as long you are doing that for more than N seconds. That's why the "Keep your distance" yelling. N is just a bit too low recently (fixed on next update), but stealing itself works as before (one of "befores", anyway), except with increasing xp (due to increased difficulty) for consecutive steals from the same critter.
