Ungaurded, when in the act of stealing.

I don't see how this is at all an abuse or any kind of greifing. I honestly think you all have misinterpreted my suggestion, so i'll try to explain again.
Scenario:
You made the choice to use the "STEAL" Skill on another player. Whether this was in order to steal from the victim or just to look through his belongings, you still using the "STEAL" skill on them, diliberately going through their pockets.
Thus, with this mechanic, you would be able to actually defend yourself from this thief, instead of just dealing with him shadowing you 24/7 at the shops. Besides, they dont risk anything but a minute and 30 seconds of time (death timer and getting back)
So I honestly don't see how this is even remotely an abuseable feature.
And I have experience with thief as well, I have a thief that stalks ncr as all thieves or use him to plant npcs with things. I don't see how this would make my job any more difficult seeing as I dont risk, dont waste time, and only piss off the other player without giving a chance of retribution unless I "Randomly" fail.

The abuse is in temporal character of the feature - and defender not having it under control. As they've already said, thief would close inventory immediately as he see you preparing to strike, and enjoying you getting killed because he can no longer be attacked without retribution.
If it was something like yelling help, using steal back on him or whatever to achieve effect of thief getting caught it'd work. But honestly that's what skill check is for.

Oh ok I get it now. Well that's kind of simply to solve though I am not entirely sure.
Make it where there is a 3 second timer after you close the inventory by that specific player only.
When the thief is attacked, within this timer, until his combat timer is over, he will remain unprotected (and with the Namecolorizing so you know when it ends)
