Criteria for guard ignorance?

I was going about my business in Shady Sands when I noticed some girl trying to steal from me.
Instead of doing something logical like moving out of the way, I decided to pump her full of lead (Although she didn't die).
I was then annihilated by the guards and had my corpse looted.
This confuses me as I've seen people kill others that have tried to steal from them, yet the guards didn't bat an eye.
So, when do guards start ignoring it? Is it after something is stolen (I reacted fairly quickly) or only on a failed attempt?

If the theif fails OR is spotted by the guards, they can then be killed.

If a guard says something like: "Victim, it appears Theif is interested in your possessions"
They've been spotted.

Once they die, they will become protected again.

Either nearby guards say that or you'll get a message in your inventory saying that the thief failed to steal from you.
