Fallout D20 - is fan-made on-line RPG, based on NWN2

When I take something from a shop, this thing is not in the shop anymore, it's only in my pocket, so it's stealing. The models from FO3/NV are still here, so it's copy.
And yes, this is important. From a juridic view as well as from a philosophic view.

FOnline consists mostly from Fallout art, would you consider it stealing? (granting, the FOE is self-made, while D20 picks everything from NWM2 and F3)
No, because it's a non-commercial project, thus, a mod. But i wonder if Beth would be pissy about their copyrights.
Also, plain copypaste objects from other games isn't very original, though. I hope there will be more original content.

So from law and philosophic point of view e-stores that contain music, games or e-books doesnt exist and are only abstract vitrual beings? Nice logic :)
