What happens if I die in an encounter but my merc doesn't? is the merc lost?

Yes, it's lost.

@below comment: Oh right, you'll need to get rid of him, forgot about that. Use: ~disbandparty away_team command, type it on client.

Make sure that all the slaves/mercs you want to keep are on the same map as you when you do the command, else they will be deleted too.

Yeah looks like it lost like Abe say.
I'm not very expert with slaves/mercs and don't know much about them.
